Employment Contracts In Algeria

  • Professional employment in Algeria should always come with a written letter of employment. 
  • Most employers include a probation period between 1 and 3 months.  
  • Anemployment contract should specify the nature of the employee’s role and describe the employee’s duties. 
  • Employees are typically entitled to a 6 month notice period, but this can be extended to 1 year for skilled employees. This notice period can be extended by 5 days for each year of service, up to a maximum of 30 days. 
  • Severance pay is required for employees that have worked for more than 2 years. Employees are entitled to 15 days of paid severance for every year of service after 2 years. However, there is an upper limit of 3 months’ pay. 

Working Hours

  • The working week in Algeria runs from Sunday to Thursday with Friday as a common day of rest. 
  • Full-time employees generally work 8 hours per day, 40 hours per week. 
  • Part-time employees are expected to work 20 hours per week. 
  • Employees are entitled to a higher hourly rate for overtime. This is generally 150% of the normal hourly rate. 

Types Of Leave

Holidays and Annual Leave

  • Algeria has 6 official national holidays. 
  • Employees are entitled to a minimum of 3 weeks of paid vacation if they have been with the company for less than 5 years.  
  • Employees get 30 days of paid leave per year. This leave is calculated at a rate of 2.5 days per month throughout the year.

Sick Leave

  • Employers generally pay 50% of employee’s salary for the first 15 days of an illness.  
  • Employers can add more sick leave for an employee, depending on the nature of their employment contract. 

Parental Leave

  • According to Algerian law, female employees are entitled to 14 weeks of maternity leave. 
  • Maternity leave can be taken as long as the employee has been working for 15 days or 100 hours before the start of maternity leave. 
  • Male employees are entitled to 3 days of paternity leave. 

Tax Law

  • Employers in Algeria are responsible for withholding all taxes and social contributions. 
  • Employers contribute the equivalent of 26% of the employee’s salary toward their social security.  
  • Employees contribute 9% of their salary to social security. 
  • Personal income tax is based on a sliding scale depending on how much the employee earns. There is no tax imposed on employees earning less than 120,000 DZD. The rate then increases to 20% for income under 360,000, 30% for income under 600,000, 35% for income under 1,200,000, and 40% for all income above. 
  • The corporate income tax rate in Algeria is set at 26% of the company’s net profit. However, this is set at 19% for manufacturing companies and 23% for construction companies.
